Terms of Service – Fionn Scally Photography

These Terms of Service ("Terms") govern your access to and use of the website fionnscallyphotography.com (the "Website") and the purchase of digital photography products offered by me, Fionn Scally ("I", "me", "my", or "Photographer").

By accessing the Website, viewing client galleries, or completing any purchase, you agree to these Terms. If you do not agree, please do not use the Website or make purchases.

1. About Me I am Fionn Scally, an independent photographer based in Athlone, County Westmeath, Ireland, operating under the name Fionn Scally Photography. Contact: info@fionnscallyphotography.com

2. Services and Products I offer photography services and sell digital downloads of high-resolution photographs through secure client galleries hosted on Pixieset. Available products include:

  • Single high-resolution photo downloads

  • Bundled packs (3-pack, 5-pack, 10-pack)

  • Full gallery downloads (all edited photos from an event)

Digital files are delivered instantly following successful payment via Stripe.

3. Pricing and Payment All prices are quoted in Euros (€) and include any applicable taxes or VAT where required. Prices are clearly displayed prior to checkout. Payments are processed securely through Stripe. By completing a purchase, you authorise me to charge the selected payment method. I do not store full payment card details.

4. Intellectual Property and Licence All photographs remain my exclusive intellectual property and copyright under Irish and international law. Upon receipt of full payment, you are granted a limited, non-exclusive, non-transferable licence for personal, non-commercial use only. This licence permits:

  • Viewing and storing the files

  • Sharing on personal social media (credit to @fionnscallyphotography is appreciated)

  • Printing for personal, non-commercial purposes

You are prohibited from:

  • Selling, sublicensing, reproducing, distributing, or commercially exploiting the images

  • Removing or altering any watermarks (where applicable on previews)

  • Using the images for advertising, resale, stock photography, or any commercial purpose without a separate written licence agreement from me

Any unauthorised use may result in legal proceedings.

5. Delivery, Refunds, and Cancellations Digital products are non-refundable once downloaded or access is provided, as they are non-returnable and instantly consumable. By purchasing, you expressly consent to immediate digital delivery and waive your statutory right to cancel under the EU Consumer Rights Directive (2011/83/EU) and the Irish Consumer Rights Act 2022 for digital content. In the event of a corrupted or inaccessible file, please contact me within 7 days of purchase for a replacement at no additional cost.

6. Client Galleries Galleries are made available for a limited period (typically 30–90 days; refer to your gallery notification). I reserve the right to remove access after this period. It is your responsibility to download and back up purchased files promptly. Free web-resolution previews (with watermark) may be available for social media sharing.

7. Limitation of Liability To the maximum extent permitted by law:

  • The Website and products are provided "as is" without any warranties, express or implied.

  • I shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Website or products.

  • My total liability to you shall not exceed the amount you paid for the relevant product(s).

8. Indemnification You agree to indemnify and hold me harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the photographs.

9. Amendments I may revise these Terms from time to time. Continued use of the Website or services following any changes constitutes your acceptance of the updated Terms.

10. Governing Law These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.

11. Privacy and Data Protection Your personal information is processed in accordance with my Privacy Policy (linked separately) and applicable data protection laws, including the General Data Protection Regulation (GDPR).
